HOW TO CALCULATE CHILD SUPPORT?

Transcript

“So child support in the state of California is determined by a guideline formula. That just means that the legislature has prescribed the mechanism by which support’s going to be computed. So they’ve got different input factors, for example: 1) How much do you make per month? 2) What’s the current timeshare with the child? 3) What does the other person make? And other things like that.

It’s important to know before you go into a child support proceeding, whether it’s in a divorce or part of a separate proceeding for child support, what you’re going to pay. How do you do that? Well, there are a lot of online calculators that are available where you can get information that’s either exact or pretty close to what the court is going to do.

Now the problem with that is that even though you have a formula it’s up to the court oftentimes to determine what numbers are going to be used for what. So it may never be precise, but you should know going into a proceeding generally what you’re going to have to pay, and your lawyer should be able to do that for you and explain to you why you’re going to have to pay that amount.”
