My Parents Died Without an Estate Plan. What Should I Do With Their House?

“Well, because they died without a trust, you’re going to have to file a petition to open the estate with the probate courts or get an attorney to help you do this and walk you through the process.

It’s about 12 to 18 months depending on if people are fighting about things and the attorney can help you either sell the property or distribute it out to you and your siblings directly so your name’s on title.

Because there isn’t a trust, the probate process is more lengthy it costs more and is going to take more time at the end of the day a more difficult process than if the property was in a trust. The best way to deal with this is to retain an attorney to discuss your options with them.”
