“In a probate, does my attorney get paid with money from the estate?

Okay probate, yes. So the attorneys are going to be paid out of the estate. There’s a statutory requirement in California that lays out exactly how much somebody receives to represent the administrator of an estate, however the attorney can also ask for extraordinary fees also known as EXO fees and that’s an additional request to the court. All of these fees still have to be approved by the court though.

At the end of the case there’s going to be a petition for final distribution and that’s where those requests are going to be for statutory compensation as well as extraordinary fees, but that money generally always comes out of the estate.”
