THE UCCJEA IN CALIFORNIA

The Uniform Child Custody Jurisdiction Enforcement Act (UCCJEA) is a law that has been adopted by the majority of states within the United States, including California, to establish guidelines and procedures for determining which state has jurisdiction over child custody and visitation issues when multiple states are involved. What is the Purpose of the UCCJEA in a California Child Custody Case?

The UCCJEA in a California custody case serves several important purposes, including:

HOME STATE DETERMINATION:

The UCCJEA establishes rules to determine the child’s “home state.” California considers the home state to be the state where the child has lived with a parent or guardian for the six consecutive months preceding the custody proceedings. If the child is less than six months old, the home state is the state in which the child has lived since birth.

EXCLUSIVE JURISDICTION:

Once a court in California has made a child custody determination, it retains exclusive jurisdiction as long as the child or at least one parent continues to reside in California. This means that California courts have the authority to modify or enforce the custody order if the jurisdictional requirements are met.

TEMPORARY EMERGENCY JURISDICTION:

California, like other states, has provisions for temporary emergency jurisdiction. If a child is present in California and the child has been abandoned, or the emergency jurisdiction is necessary to protect the child because the child, the child’s sibling, or the child’s parent is subjected to or threatened with mistreatment or abuse, a California court can assume jurisdiction on an emergency basis even if California is not the child’s home state.

ENFORCEMENT OF CUSTODY ORDERS:

California’s UCCJEA provides mechanisms for recognizing and enforcing custody and visitation orders from other states. If a valid custody order has been issued by a court in another state and registered in California, California courts are generally required to enforce that order.

COMMUNICATION BETWEEN COURTS: 

The UCCJEA promotes communication and cooperation between California courts and courts in other jurisdictions.
